Syria OKs new constitution as shelling continues

A referendum in Syria that overwhelmingly approved a new constitution was "unlikely to be credible," the United Nations said on Monday as it urged the country to focus on bringing an end to its bloodiest turmoil in decades.

The Syrian Interior Ministry said on Monday that a reformed constitution, which could keep President Bashar Assad in power until 2028, had received 89.4 percent approval from more than eight million voters who cast their ballots on Sunday.

"While a new constitution and the end of the Baath party monopoly on power could be part of a political solution, a referendum must take place in conditions free of violence and intimidation," U.N. spokesman Eduardo del Buey told reporters.

"It is unlikely to be credible in the context of pervasive violence and mass human rights violations," he said.


Syrian dissidents and Western leaders dismissed as a farce Sunday's vote, conducted amid ongoing violence, although Assad says the new constitution will lead to multi-party elections within three months.

Earlier on Monday, Syrian artillery pummeled rebel-held areas of Homs before the announcement that a vote had approved a new constitution proposed by President Assad.

A Syrian activist group said Monday that 135 people have been killed across the country, including 64 who died while fleeing an embattled area in Homs. The Local Coordination Committees, one of the main Syrian activist groups, said the dead included three women, three children and four soldiers.

No clear successor to Assad's 'coup-proof' rule in Syria

Shells and rockets crashed into Sunni Muslim districts of Homs that have already endured weeks of bombardment as Assad's forces try to stamp out an almost year-long revolt against his 11-year rule.

"Intense shelling started on Khalidiya, Ashira, Bayada, Baba Amr and the old city at dawn," opposition activist Mohammed al-Homsi told Reuters from the city on the Damascus-Aleppo highway.

"The army is firing from the main thoroughfares deep into alleyways and side streets," he said, adding that at least two people had been killed.

Syria referendum goes ahead amid violence

The London-based Syrian Observatory for Human Rights said later at least seven people had been killed by shelling in Baba Amr. The accounts of opposition activists were echoed by those from other observers, including the Red Cross.

As violence turns to war in Syria, the country votes on a referendum that would limit the government's powers. NBC's Richard Engel reports.

At least 59 civilians and soldiers were killed on Sunday in a violent backdrop to a referendum on a constitution that offers some reforms, but could enable Assad to keep power until 2028.

The International Committee of the Red Cross, which has said conditions in parts of Homs are worsening by the hour, has failed to secure a pause in the fighting to allow the wounded to be evacuated and desperately needed aid to be delivered.

"We are still in negotiations. Since the beginning, the objective has been to go in and evacuate people and bring in assistance. Every hour, every day makes a difference," ICRC spokesman Hicham Hassan said in Geneva.

New sanctions
European Union foreign ministers, meanwhile, agreed new sanctions against Assad's government on Monday, targeting its central bank and several cabinet ministers to try to curb funding for the government.

The measures, expected to be enforced this week, include prohibiting trade in gold and other precious metals with Syrian state institutions and a ban on cargo flights from Syria, officials said.

Syrian activist: 'You hear the sounds of torture all the time'

British Foreign Secretary William Hague said the sanctions were crucial to putting pressure on Assad to end violence that has killed thousands of civilians over the last 11 months.

"I hope we will agree further sanctions today which will further restrict the access to finance in particular of the regime," Hague told reporters before the meeting.

Echoing comments by other ministers, Hague said any military involvement in Syria to lend support to anti-Assad rebels was off the table for now, even in the form of a peacekeeping force that some Arab states appear to favour.

"Of course for that to work properly there would have to be a peace to keep. At the moment we don't have that," he said.

Italian Foreign Minister Giulio Terzi said sanctions were the most the EU could do for now, saying it was the best that could be done without military intervention.

The author responds to comments reappraising ?Critical Legal Histories? (CLH) (1984). CLH critiqued ?evolutionary functionalism,? the idea that law is a functional response to a typical modernizing process. CLH argued that ?society? was partly constituted of legal elements and that law was too indeterminate to have reliably regular functional effects. CLH has been misinterpreted as calling for a return to internal histories of ?mandarin? doctrine: all it said was that some doctrinal histories were valuable, without privileging them. This response clarifies that the relations of law to society and social change, and of high-level official law to everyday local law are distinct issues. CLH is mostly moot today, since social-legal historians have incorporated its insight that legal concepts are embedded in everyday social practice. But other fields have revived deterministic Whiggish accounts of progressive development and of law functional to it?to which CLH's critique still seems relevant.

Neither birth nor death stops a flock, new theory shows

ScienceDaily (Feb. 24, 2012) ? Neither births nor deaths stop the flocking of organisms. They just keep moving, says theoretical physicist John J. Toner of the University of Oregon. The notion, he says, has implications in biology and eventually could point to new cancer therapies.

Picture any scenario in which self-propelled organisms -- animals, birds, bacteria, molecules within cells, cancer cells, fish, and even tiny plastic rods on a vibrating table -- move as a swarm or flock in the same direction. Eighteen years ago, Toner co-developed two equations that together provide a complete theory of flocking for "immortal" flocks -- those in which creatures are not being born and dying while the moving.

Now he has extended that work to include the effects of birth and death.

The new equations are as complete a description of flocks as the Navier-Stokes equation is of fluid dynamics. This equation, named after French physicist and engineer Claude-Louis Navier and British scientist George Gabriel Stokes applies equally well to all fluids; air, water, honey and the oil from the Gulf of Mexico disaster are all described by it. All of the differences between these very different fluids can be incorporated into the Navier-Stokes equation by changing the value of one number, called "the viscosity." Large values apply to sticky fluids like honey and oil, while smaller values describe air and water.

The Navier-Stokes equation has been used successfully for more than a century in the design of aircraft, automobiles, plumbing and power stations.

Toner's equations likewise work for all flocks, and contain some numbers that must be adjusted to account for differences between different kinds of flocks. The earlier work on immortal flocks has been applied to the flocking behavior of birds, particularly studies of starlings in Rome by Andrea Cavagna and Irene Giardina.

In a new paper -- "Birth, Death, and Flight: A Theory of Malthusian Flocks," published in the Feb. 24 issue of the journal Physical Review Letters -- Toner shows that flocking is even robust against birth and death. The finding, he said, is especially important for many other organisms that flock, especially bacteria, which may contain millions of individuals that are constantly dying and being replaced by the reproduction of others as the swarm moves.

"A flock can keep moving in the same direction for times much longer than the lifetime of any individual member," said Toner, a member of the UO Institute of Theoretical Science and a professor in the physics department. "Individuals are being born and dying but their direction and motion can persist much longer than the lifetime of any individual creature."

Secondly, he added, the density changes of such a "mortal flock" -- where some members are leaving by death and joining by birth -- create persistent but predictable fluctuations. "Birth and death are very important in microbiological flocks, such as swarms of bacteria or in collections of self-propelled molecules that flock in most living cells."

This fundamental new knowledge already is applicable to understanding the movement of molecules within cells -- in particular, mitotic spindles that launch the machinery of cell development and division, Toner said.

In mitotic spindles, individual molecules live for only about 20 minutes, but spindles live and continue their work for days, he said. "The motion continues as dead molecules are replaced by newly synthesized molecules, as well as by molecules which immigrate in to take their places."

Through the application of his new theory to the study of mitotic spindles, Toner said, it may be possible to design specifically targeted cancer therapies that, unlike current chemotherapies, would only kill aberrant, or diseased cells, and allow desirable, healthy ones to live. "In reality, such applications are a long way off," said Toner, whose research is supported by the National Science Foundation.

"This study shows us how fundamental physics and mathematics deployed to explain an everyday occurrence in nature can spin off with potentially life-saving medical applications," said Kimberly Andrews Espy, vice president for research and innovation at the UO. "This cutting-edge research conducted at the University of Oregon is another great example of the widespread applications and potential benefits that basic research and the promise it holds to address the real problems of today and tomorrow."

In September, Toner will embark on a one-year sabbatical to do additional research on flocking, or collective behavior, at IBM Yorktown Heights and the University of California, Berkeley, under a fellowship from the New York City-based Simons Foundation.

DreamWorks animator Jamaal Bradley has been a long-time aficionado of pencil tests, and his website Pencil Test Depot has evolved into the place for collecting and sharing pencil tests. Encompassing animators from the Golden Age of animation through today?s heavyweights Bradley?s website is a valued resource for both aspiring animators and professionals in the field.

The pencil test, though rarely seen by anybody outside of a film?s production, reveal one of the most intimate views into an animator?s thought process. It is the lifeblood of the hand-drawn animation pipeline; it is through the pencil test that an animator evolves a character?s personality and fine-tunes the movement and staging of a performance before it?s passed down the line to the assistant animators.

But in a CG world, what has become of the pencil test and drawing in general? Cartoon Brew spoke with Jamaal Bradley about his site Pencil Test Depot, the role of drawing in CG, as well as his own animation career and work as a teacher. The New Jersey-born artist currently works at DreamWorks Animation?s Glendale studio as a Senior Animator on The Croods. Bradley other credits include Disney?s Tangled and Sony Picture Imageworks? Open Season and Monster House. Although all of his recent projects have been CG animation, he?s kept his hand-drawn animation skills sharp by relying on it for some of his preliminary scene thumbnails as well as his work as a teacher at iAnimate.

Chris Arrant: PencilTestDepot.com has become a hit in the student animation community. What led you do create?Pencil Test Depot, and did you know it would make such a big impact on animation students?

Jamaal Bradley: Pencil Test Depot was around for a while before it went public. I love animation and the beauty of looking at a well crafted pencil test makes me smile externally and internally. It probably sounds corny but that?s what it does for me; like food for the soul.?? I had a personal site with pencil tests on it and I had tests I received from friends, stuff I shot myself, and things I was finding on the web. I initially created it for personal growth and didn?t think about maintaining it as a blog. Only one other person had access to it and he convinced me to open it to the public.

? ?Jamaal if you make it public and ask for people to donate works, you will surely get more pencil tests and I bet people would appreciate seeing the stuff you have also??

It made perfect sense and it worked. I am very happy people enjoy the site and support it.?? Chris: When you were studying animation, I assume you were being inspired by pencil tests of traditional animation like the ones you post on the site. Was it disappointing that the industry changed so rapidly and that you?re not animating more pencil tests like the ones on Pencil Test Depot?

Jamaal: It is sad that studios are not generating more 2D films, but times always change. I really do enjoy 2D films, but how do you change public opinion? You have to be amazed by the technological advances of CG and I believe the general public can see that aspect of the films.?Using that technology to make entertaining movies that are visually stunning with good stories will draw a crowd. I am not saying this draw can not be done with 2D but the audience wants something different than what they saw in the 90?s. There is something different about moving artwork that has only been generated really by materials that come from the earth; pencil and paper.

I don?t want to say I am disappointed by the evolution of animation because I believe there is still someone out there who is going to make a 2D film that will generate the revenue that a CG film brings in. . . .It?s just a matter of time. Chris: Do you think there?ll ever be a day when animators will be studying rough CG animation with the same enthusiasm as we look at drawn pencil tests today?

Jamaal: That?s an interesting question. I don?t know if CG will have that kind of following; anything?s possible. There will be great shots that animators will reference but it?s hard to say if it will be prized as much drawings. There is an idea for someone! A CG animation blog with great shots from all of the computer generated films. It would be a great library of items to look at.

Chris: Learning and sharing information drives a lot of what you do. You?ve taught online courses and developed instructional videos. You?re developing a video right now called Acting, Entertainment, & Variation that?s due out in November. What can people expect to learn from this new video?

Jamaal: I think teaching may be apart of who I am. My mother, four of my aunts and my wife are teachers. I was raised by educators so something probably rubbed off a long the way. Like anything teaching takes time to get skilled at and I surely would like the time to be better at it.

I received some great feedback from the first video [I made], and some very good requests that I didn?t have in the first one. This tutorial?Acting, Entertainment, & Variation? will go over various ideas pertaining to acting that we discuss inside of the studio as well as a few key points that specifically hit on entertainment value in what we do. Even though the last video went through shot creation, I will be doing a bit more in this one as well. I will also go over my bad and good reference and explain why they get these labels, application to the CG puppet, and go over some of the theories that i have learned over the years. There will also be insight from a few veterans that everyone knows in our business.

Chris: We?re looking forward to that. You recently posted a clip (above) from Tangled where you showed how you planned out some of the secondary cape action through drawings. Can you explain how drawing is incorporated into your CG process? I?m assuming you thumbnail everything out, but do you do a lot of what we saw in that clip too?

Jamaal: I definitely draw a lot while I am on a production. Getting into animation you are inspired by those who came before you. Seeing all of those great thumbnails by pros while I was a student just made want to do it as well. Once I became a professional that part of the process stayed with me into CG.

Over the years I have tried to refine how I use drawings and thumbnails. Even when I worked in games I drew out the actions I wanted. For me it?s quicker to draw an appealing and functional pose for the shot or action I am working on. The way I use thumbnails and drawings is to hash out my thoughts and then build on them. You can say it?s a waste of time but for me the more I plan the easier the animation will go.

A great plus is if you get a director who used to be an animator or story artist, you can show them the drawings and the get your ideas immediately; I love that! Luckily a lot of studios have software that allows you to draw over your CG. I use this to refine poses or make out arcs and paths of action. In the case of Tangled, we were encouraged to draw specific actions of Rapunzel?s hair or anything that needed specific contact. For the Gothel Death sequence, I drew the cloak in and the hair she is picking up for all of those shots. I wanted it to look a specific way and Glen Keane really wanted to get a nice shape on the hood as her body was against the window. He and the directors liked what I did, so it was up to FX to mimic it?I think they really pulled it off.

Chris: Whereas you could work either as a traditional or computer animator, many younger CG animators coming into the business aren?t particularly skilled draftsmen. Are they at a disadvantage against those who know drawing, or do you think it?s possible to be just as good a CG animator without solid draftsmanship skills?

Jamaal: I don?t think the guys who are not draftsmen are at any huge disadvantage. There are some phenomenal CG animators who can?t even draw a circle. The one thing drawing can give any animator is a sense of appeal beyond something just ?moving correctly?.

I use the intro scene of O?Malley from Disney?s Aristocats in my classes to illustrate this point. Not once when you are watching the animation do you ?not believe? he is a cat. He is performing humanistic movements but never breaks out of how a cat?s anatomy works. The point is that it is a realistic ?animated? cat. When I say animated I mean an exaggeration of real life. We as animators can make the audience believe the movements and we decide the degree of exaggeration. Just because the CG human looks slightly real doesn?t mean you can?t push things and make them a bit more appealing. When you make a drawing you have to push things a bit to draw the viewer in otherwise is just a boring drawing. Norman Rockwell is a great example of pushing life! In general, being good at anything that can help your craft is always beneficial.

Chris: If there?s one thing you could tell animators coming into the business today?a piece of advice that you wish someone had told you?what would it be?

Jamaal: This is not something I wish someone told me but it?s advice?. Help lift your peers, the ones that are excelling and the ones that are struggling. Be a gentleman and continue to remind yourself that animation is one part of life, so live yours to be a better animator.

Chris: Are there certain pencil tests out there that you?re looking for that you haven?t found yet, like the Holy Grail of pencil tests?

Jamaal: YES! These tests have been locked away and there are only a tiny few out there. Looney Tunes and Classic Tom & Jerry pencil tests! I have not seen large chunks of pencil tests from either one of these. I never really got into Mickey? I was a Looney Tunes and Tom & Jerry kid. I used to sit on my grandmother?s floor with a piece of Wonder Bread and watch them all day; even the?crazy racist ones. If someone is sitting on any of these, share them with the world!

BRUSSELS (AP) ? A second, euro130 billion ($172 billion) bailout and a deep debt write-off for financially stricken Greece will ward off a financial disaster in Europe.

Economists, however, only give the deal a slim chance of putting the country on the path to economic recovery ? and steadying its place in Europe's currency union.

Agreement on the bailout, reached early Tuesday after an all-night summit of finance ministers seven months after it was first proposed, will give Greece euro130 billion in loans through 2014 from other eurozone governments and the International Monetary Fund. It's the country's second bailout, following a euro110 billion rescue secured in 2010 that didn't return the country to solvency.

The agreement also assumes that banks and investors owed money by Greece will take new bonds that reduce their holdings by more than half.

In return for the second bailout, Greece has agreed to painful and humiliating measures imposed by its mistrustful partners which also use the euro, annoyed after two years of what they say are broken promises to reform. Athens agreed to cut spending and wages, and to permit outsiders to supervise its finances through the presence of European Union and International Monetary Fund officials permanently stationed in Greece. The rescuers also demanded a separate account for the aid money and legal guarantees that creditors get paid before teachers, doctors and police do.

The finance ministers from Greece and the other 16 countries that use the euro wrangled until the early morning over the details of the rescue, squeezing last-minute concessions out of private holders of Greek debt who agreed to lose 53.5 percent of the face value of their investment to avoid even more severe losses expected if Greece fails to pay euro14.5 billion in debt coming due March 20.

The fear is that an uncontrolled bankruptcy could unleash market panic across the rest of the continent, further unsettling other struggling other debt-stricken countries such as Ireland, Portugal or the much bigger Italy or Spain.

Serious risks of failure include the chance that Greece's economy remains in a deep recession ? where it's been for four straight years ? instead of returning to growth in 2013 as the deal assumes. That would undermine chances of paying even the reduced debt load, estimated at a still-high 120 percent of annual economic output in 2020, down from 160 percent now.

Additionally, political outrage over the cutbacks could lead Greece politicians to balk at the tough conditions. That could push rescuer countries ? led by Germany ? to cut off further funding.

Elections in Greece are expected in April. The leaders of the two main parties have committed to the cuts and reform program, but anti-bailout parties have been gaining in the polls.

Growth is the key. But Greece's economy shrank 7 percent in the fourth quarter of last year and unemployment is 19 percent, a consequence of cuts in public wages and increased taxes inflicted during a downturn.

If that keeps up, even the rescuers acknowledge the reduction goal of 120 percent of GDP is long gone.

Success "really depends on the assumptions you make in terms of growth and interest rates," said Diego Iscaro, an economist at IHS Global Insight. "The risks are clearly on the downside. The main risk comes from the economic situation, the economic dire straits."

"By austerity alone, Greece will not solve the problems it has at the moment. We don't know when the economy will return to growth and how it will grow."

Unless something breaks the cycle of austerity and contraction "something will have to give."

Even if it later balks at the conditions for the bailout, Greece would have difficulty writing down the new debt it issued to private bondholders, who demanded stronger legal protections. Official creditors ? the IMF, the eurozone countries and the European Central Bank ? would also have difficulty accepting more writedowns. Inability to pay ? or unwillingness to accept the harsh conditions ? could lead to a non-negotiated "hard" default that could end in Greece leaving the euro.

The eurozone and the International Monetary Fund hope the new program will eventually put Greece back into a position where it can survive without external support. Both private and official creditors went beyond what they had said was possible in the past. On top of the new rescue loans, Athens will also ask banks and other investment funds to forgive it some euro107 billion ($142 billion) in debt, while the European Central Bank and national central banks in the eurozone will forgo profits on their holdings.

The deal "closes the door to an uncontrolled default that would be chaos for Greece and Greek people," said European Commission President Jose Manuel Barroso.

But despite those unprecedented efforts, it was clear that Greece was at the very best starting on a long and painful road to recovery. It is being pushed to make its economy more business-friendly and productive by opening access to closed trades and professions; halting rampant tax evasion; allowing more flexibility in wage bargaining between companies and unions; simplifying starting a business; and cutting its bureaucracy.

But those measures will take years to work ? if Greece's politicians are willing or able to push them through.

"It's not an easy (program), it's an ambitious one," said Christine Lagarde, the head of the IMF, adding that there were significant risks that Greece's economy could not grow as much as hoped.

Including Greece's first bailout worth euro110 billion ($146 billion), the new deal means every Greek man, woman and child will owe the eurozone and the IMF about euro22,000 ($29,000).

In Athens, the reaction to the news was a mixture of relief the country has avoided financial catastrophe and fear of a dark future.

"I don't see it with any joy because again we're being burdened with loans, loans, loans, with no end in sight," architect Valia Rokou said in the Greek capital.

Greek politicians nevertheless greeted the package as a turning point for their battered country.

"It's no exaggeration to say that today is a historic day for the Greek economy," said Greek Premier Lucas Papademos, who had rushed to the finance ministers' meeting to lend weight to his country's pleas for help.

For those who Greece owes money, the bond swap will lop euro107 billion off Greece's euro352 billion load. On top of that, investors will be asked to give Athens 30 years to repay them, compared with just under 7 years.

Average interest rates would fall to 3.65 percent from around 4.8 percent.

Overall losses for private bondholders would be above 70 percent when accounting for the new bonds' longer repayment period and lower interest rate.

Private investors weren't the only ones having to give ground. The eurozone countries will reduce the interest that Greece has to pay for its first package of bailout loans to 1.5 percentage points over market rates from between 2 percentage points to 3 percentage points currently.

At the same time, the European Central Bank and the national central banks in the countries that use the euro will forgo profits on their Greek debt holdings, again reducing the costs for Greece.

But several hurdles remain before Greece will see any of the money or other benefits of the new program.

Apart from the implementation of more than 30 different savings and reform measures by Greece, the new bailout has to be debated by parliaments in several member states, including Germany, the Netherlands and Finland.

The IMF also still has to decide how much of the euro130 billion bill it is willing to stump up. Going into the meeting, the Washington-based fund had indicated its contribution will be lower than the one-third of the total it has provided in previous bailouts.

IMF chief Lagarde said the fund's board would decide on its contribution in the second week of March.

"In doing so it will have in mind the overall program, but also additional matters such as the proper setting up of a decent firewall," Lagarde said with reference to Europe's current and future bailout funds.

At the moment, the overall ceiling for eurozone rescue loans has been set at euro500 billion ($663 billion), much of which has already been committed to Ireland, Portugal and now Greece. Euro leaders will decide at their summit in early March whether that ceiling should be increased.

On top of that, it will also take some time to see how many private creditors will participate in the debt relief and how many will have to be forced to sign up through new legal clauses. The representatives of the private bondholders said they were confident that investors would find the deal attractive, but some analysts fear that imposing losses on even some bondholders may destabilize markets.
