ALJ Gildea Rules On Motions In Limine In Certain ... - ITC Law Blog

On August 17, 2012, ALJ E. James Gildea issued the public versions of Order No. 60?(dated July 26, 2012), Order No. 62 (dated July 30, 2012), and Order No. 67 (dated August 2, 2012) regarding various motions in limine filed by Complainant Apple Inc. (?Apple?) in Certain Portable Electronic Devices and Related Software (Inv. No. 337-TA-797).

By way of background, the investigation is based on a July 8, 2011 complaint alleging violation of Section 337 in the importation into the U.S. and sale of certain portable electronic devices and related software that infringe certain claims of U.S. Patent Nos. 7,844,915 (?the ?915 patent?); 7,469,381; 7,084,859 (?the ?859 patent?); RE 42,738 and 7,920,129 (?the ?129 patent?) (collectively, ?the asserted patents?).? The respondents in this investigation are HTC Corp., HTC America, Inc., and Exedea, Inc. (collectively, ?HTC?).? See our July 11, 2011 post for more details.

In Order No. 60, ALJ Gildea ruled on Apple?s motion in limine to preclude three of HTC?s experts from testifying regarding (i)the doctrine of prosecution history estoppel, (ii) whether certain claims of the asserted patents were narrowed during prosecution, and (iii) the effect of any narrowing with regard to the doctrine of equivalents. Apple argued it would be improper and prejudicial for the experts to opine on matters of law as they do not have specialized knowledge, experience, or expertise that would enable them to offer reliable opinions regarding the effect of such amendments.

HTC opposed the motion, alleging its experts are entitled to testify regarding the facts and substance of these amendments, the resulting change in claim scope, and the fact that Apple?s proposed equivalents were foreseeable when the amendments were made. HTC added that the testimony relates to underlying factual issues that inform the prosecution history estoppel analysis and leaves the ALJ to decide the legal effect.

The Commission Investigative Staff (?OUII?) supported Apple?s motion in-part, arguing that HTC?s experts should be permitted to testify from the perspective of a person of ordinary skill in the art as to whether the patent applicants narrowed the scope of their invention, but should not be permitted to testify on the ultimate legal question of whether a presumption of estoppel exists.

After considering the parties positions, ALJ Gildea denied the motion noting that the Federal Circuit has held that this type of testimony is relevant to a factual inquiry for which expert testimony is appropriate, thereby allowing testimony as to whether the amendments narrowed the scope of the invention from the perspective of a person of ordinary skill in the art and whether any alleged equivalents were foreseeable at the time. As to the testimony on the ultimate legal issue regarding the effect of any amendments, the ALJ finds the motion premature, stating that the parties could make timely and appropriate objections at the evidentiary hearing.

In Order No. 62, the ALJ ruled on Apple?s motion in limine to preclude certain claim construction testimony by one of HTC?s experts, Dr. Bederson, that it alleged would conflict with ALJ Gildea?s claim construction order, Order No. 57. For more details on this claim construction order, see our July 31, 2012 post. Specifically, Apple asserted that Dr. Bederson attempts to construe the term ?the event object invokes? of the ?915 patent by further construing the term ?event object? to require that it be able to ?execute methods or functions for scrolling and scaling.? HTC, Apple argued, voluntarily waived construing this phrase during the Markman process. Apple also asserted that Dr. Bederson ignores the parties? agreed constructions and injects a requirement of ?identification? in certain claims of the ?859 patent, despite ALJ Gildea?s rejection of an identification requirement in relation to the ?pinch or bracket? limitation of these claims.

HTC opposed the motion, arguing that Dr. Bederson?s opinions are related to the plain and ordinary meaning to a person of ordinary skill in the art, specifically, to the plain and ordinary meaning of ?invoke? and ?pinch.? HTC added that Apple?s objection was untimely, as Dr. Bederson addressed this issue in his March 26, 2012 report.

The OUII supported Apple?s motion in-part, asserting that HTC should not be permitted to offer arguments or testimony regarding the scope of terms to the extent that such claim constructions are inconsistent with Order No. 57. The OUII added, however, that HTC should not be precluded from offering evidence simply because Apple alleges that it relates to a new claim construction and the ALJ should determine whether the evidence is relevant under the issued claim constructions.

After considering all submissions, the ALJ granted Apple?s motion in-part, determining that HTC should not be permitted to offer argument or testimony that would be inconsistent with the claim constructions of Order No. 57 and that no party would be permitted to advance constructions for claim terms addressed in that Order. Specifically, as to ?event object invokes? of the ?915 patent, the ALJ found that Dr. Bederson was not trying to further construe the term ?event object,? but rather was attempting to advance a construction for the word ?invoke? which was not addressed in Order No. 57. As such, ALJ Gildea ruled that any evidence and testimony attempting to construe the term ?invokes? in the phrase ?event object invokes? should be precluded. Regarding ?pinch or bracket displayed data? of the ?859 patent, the ALJ found that Order No. 57 did not address whether the ?859 patent requires a ?pinch? or ?identification? of data. Thus, the parties were not precluded from presenting evidence or testimony as to whether ?identification? was required prior to further manipulation of the data.

In Order No. 67, ALJ Gildea ruled on Apple?s motion in limine to preclude three of HTC?s experts from introducing evidence, argument, or testimony that was not properly disclosed in their expert reports and deposition testimony. Specifically, Apple requested that HTC be precluded from offering evidence or argument relating to prior art combinations not timely disclosed, new invalidity arguments, and new non-infringement arguments. Regarding the undisclosed prior art combinations, Apple asserted that HTC?s expert reports merely included a laundry list of references that could be combined with various other references to render the claims obvious, but failed to meaningfully disclose the way specific combinations of prior art would render the asserted claims obvious.

Thus, Apple reasoned, HTC should? be precluded from offering any evidence regarding any 103 prior art combinations. As to the alleged new invalidity arguments, Apple asserted that, when writing its prehearing brief, it relied on communications from HTC including a narrow list of prior art which HTC intended to include in its brief with regard to the validity of the ?129 patent. However, in its briefing, HTC included additional references outside those listed in the letter. Accordingly, Apple requested that HTC be precluded from presenting evidence regarding these invalidity contentions. Apple also requested that HTC be precluded from presenting evidence on additional new invalidity arguments first disclosed in the brief and new non-infringement arguments first disclosed in the brief for which HTC failed to provide requested discovery.

HTC opposed Apple?s motion. As to the prior art combinations Apple argued were undisclosed in the expert reports, HTC asserted the expert reports did discuss each combination of prior art and that Apple should have raised any concerns as to these reports earlier. With respect to the communications from HTC to Apple, HTC argued that Apple?s reliance was misplaced and that HTC indicated its anticipation references and obviousness combinations could change and that, although it indicated it would not be using a particular reference, Philipp, as an anticipating reference or as the primary reference in certain obviousness combinations, those combinations did not include those Apple now seeks to preclude. Regarding Apple?s new invalidity and infringement allegations, HTC stated that these arguments were in-fact disclosed previously, that HTC did provide discovery related to the non-infringement arguments, that Apple?s motion does not identify which discovery is missing, and that Apple?s untimely discovery dispute is inappropriate for resolution in a motion in limine.

The OUII supported Apple?s motion in-part, supporting the motion to the extent that new prior art combinations or new details about previously disclosed contentions were raised in HTC?s brief or during the hearing. The OUII opposed the motion to the extent that these combinations and contentions were disclosed in the expert reports. Specifically, with regard to the discovery issue, the OUII opposed the motion stating that Apple had not shown any evidence that it requested discovery on the issue or pursued a motion to compel such discovery.

After reviewing the submission, the ALJ granted Apple?s motion in-part. As to Apple?s dispute regarding the sufficiency of the prior art combinations disclosed in the expert reports, ALJ Gildea ruled that Apple?s requested relief, the barring of HTC from presenting any obviousness combinations, would go too far and was unwarranted. Thus, the ALJ denied this portion of the motion, stating that any appropriate supported objection could be raised during the hearing should the experts introduce new opinions or expand upon opinions that fall outside the scope of their reports and deposition testimony. With respect to Apple?s dispute about the HTC communications, the ALJ did not find sufficient language to put Apple on notice that the list of references and combinations could change without notice and found it reasonable that Apple concluded that HTC did not intend to rely on the combinations with Philipp at issue in the motion. ALJ Gildea, accordingly granted this portion of the motion, ruling that HTC should be precluded from presenting evidence on combinations of references that were not included in the communications at issue. The ALJ clarified, however that HTC was not precluded from offering evidence on any reference with respect to the state of the art, secondary considerations, or motivation to combine as HTC reserved its right to do so in those communications.

Finally, as to the alleged new invalidity and infringement allegations, the ALJ found that these arguments were not new, rather they were addressed in the appropriate expert report. As to the discovery issue, ALJ Gildea agreed with the OUII that Apple had not shown that it requested discovery on the issue or pursued it with a motion to compel. Therefore, the ALJ denied these aspects of Apple?s motion.

Roofers as Sole Proprietors v. Workers Compensation Insurance ...

Our office had a recent conversation with an Attorney from the State?s WC Department (Dept. of Industrial Accidents) regarding Worker?s Compensation. They said that there is a real problem with small Roofers claiming exemption via the Sole Proprietor declaration and bringing in people to help with the roof as ?Independent Contractors?.

According to the State, that is illegal. These are not ?Iindependent Contractors? but are viewed as employees, as defined by their office. Either that Sole Proprietor is doing all the work by himself on the roof; i.e. solo/alone/no helper/etc., or he has employees and must provide Workers Compensation Insurance. The attorney said that there is no such thing as a Sole Proprietor Roofing Contractor!

Why should we care? Because we could be liable! Be careful accepting someone?s signature on the affidavit as exempting us from liability, especially if have knowledge or should have had knowledge to the contrary. If someone falls and gets hurt, the attorneys will be combing our department to see what we know. Could we be held negligible? Perhaps.

These injuries result in lawsuits and that means men is suits firing wildly in all directions ? don?t get caught in the crossfire.

Here in Middleton, we recently pulled a permit from a guy, under the guise of false statements on the permit, were he had claimed Sole Proprietor but had several guys working for him. He had been verbally warned, after the conversation with the State.

As of now, we hear the Owner is planning on pulling the permit and proceeding, but I caution you there as well. read the fine print to Item #3 of the WC affidavit ? it says that if a Homeowner pulls the permit and does not do the work themselves, but hires someone they need to refile and provide WC proof, likely as item #4 GC.

Bottom line, anyone on a roof for hire should be protected by Worker?s Compensation Insurance. Don?t expose yourself to liability to anyone ? your job is not is more important to you than that.

The puppy kisses and kitten purring doesn?t hurt either!

2. General Routine Check Ups
Veterinarians also love routine wellness and preventative care, especially for senior pets. It shows that you, the owner, are invested in caring for your pet. Additionally, many diseases are easiest to treat when diagnosed early on. This translates to better outcomes and healthier pets. Some veterinarians might disagree with me about the next one, since it can be gross, but dental care would be on my list of favorite procedures because it translates to immediate health benefits for dogs and cats. 4. Treatment of Curable Diseases
Any disease that can be ?cured? is always favorable as well. Hyperthyroidism in cats, or an over active thyroid, is extremely common in older cats. It usually presents with a slow history of weight loss despite a healthy appetite. It is diagnosed with a blood test examining thyroid hormone levels. Hyperthyroidism is one of my favorite diseases, because it can be cured in 99.9% of cats with an extremely safe and non-invasive procedure called I131, or radioactive iodine therapy. The catch, of course, is that this can be relatively expensive, usually around $1,000 to 1,500 to treat. Cat and dog insurance is truly an invaluable tool that can help our pets get access to lifesaving procedures for a fraction of the out-of-pocket cost.

5. Caesarian Sections
Caesarian sections and birthing can also be rewarding for veterinarians. Watching new life come into the world never gets tiring. Unfortunately, it doesn?t always go smoothly. Unlike humans, dogs can?t have scheduled c-sections, meaning many occur on an emergency basis or after hours. There is a certain sense of satisfaction and happiness felt when all the puppies are born alive and squeaking.

Although as veterinarians we deal with a lot of illness and disease, for every sad case there are many joyful pets we have been able to treat, or that come in for healthy preventative reasons. These are the cases that make veterinary medicine such a rewarding profession.

Superman, Wonder Woman lock lips as power couple

PHILADELPHIA (AP) ? Wonder Woman and Superman are an item, locking lips in a passionate embrace as the pair realize that there's no one out there like them.

The couple's kiss is the culmination of a dramatic story in "Justice League" No. 12, which marks the first full year since DC relaunched its stable of heroes with new stories, new costumes and revised origins.

DC Comics co-publisher Jim Lee, who has drawn each issue of "Justice League" since its debut, called the canoodling in Wednesday's issue not a stunt or an alternate reality smooch.

"This has been in the works for some time and we certainly wouldn't have pulled the trigger on without there being great creative benefit to the liaison," he said in an email. "Beyond the joy and sorrows of new love, there are potentially huge ramifications and dramatic ways this single relationship between these iconic characters will change the entire political and interpersonal landscape of the DC Universe."

The characters have long formed, with Batman, the triumvirate of DC Entertainment's heroes and are among the most powerful and best-known.

In the 1980s, the pair had a brief fling but Superman went on to marry Lois Lane. They also kissed in Frank Miller's "Dark Knight Strikes Again" a decade ago. In a 2006 epilogue to 1996's "Kingdom Come," the couple asks Bruce Wayne, aka Batman, to stand as godfather to their unborn child.

Since DC relaunched its characters and universe nearly a year ago, some of the origins have changed ? Wonder Woman is now the daughter of Zeus ? and the costumes have, too.

One aspect that did not survive the relaunch: Lois Lane's role as Superman's love. She's still around, but the two have never dated, nor are they likely to.

Geoff Johns, who writes "Justice League" is laying out a story that looks not only at the couple but the effects on others, too, Lee said.

"The way Geoff unfolds the story and the implications of two of the most powerful characters in the DCU becoming a team is something that goes beyond the question of 'What about Lois and Clark?'" Lee said.

"This is a statement to every nation and geopolitical organization in the entire DC Universe giving creative teams ample material to explore this relationship on so many different levels."

CHICAGO The overall rate of death in patients hospitalized with ST-segment elevation myocardial infarction (STEMI; a certain pattern on an electrocardiogram following a heart attack) decreased from 1995 to 2010 in France, with possible factors associated with this decline including an increase in the proportion of STEMI patients who were women younger than age 60, and an increase in the use of reperfusion therapy and recommended therapeutic measures following a heart attack, according to a study being published online by JAMA. The study is being released early to coincide with its presentation at the European Society of Cardiology Congress.

"Several sources, including registries specific to acute myocardial infarction [AMI; heart attack] and large administrative or billing databases, have shown a decrease in mortality in patients with STEMI over the past 10 to 15 years. This decline is usually attributed to increased use and improved delivery of reperfusion therapy, in particular primary percutaneous coronary intervention (PCI; procedures such as balloon angioplasty or stent placement used to open narrowed coronary arteries). We hypothesized that, beyond primary PCI, other factors such as temporal changes in patient population characteristics may account for part of the observed reduction in mortality of patients with STEMI," the authors write.

Etienne Puymirat, M.D., of the Hpital Europen Georges Pompidou, Paris, and colleagues conducted a study to assess the association between changes in early mortality following STEMI and patient management and risk profile. The researchers analyzed data from four 1-month French nationwide registries, conducted 5 years apart (in 1995, 2000, 2005 and 2010), which included a total of 6,707 STEMI patients admitted to intensive care or coronary care units.

During the study period, the average age of patients with STEMI declined from 66.2 years to 63.3 years, and history of cardiovascular disease, such as heart attack, heart failure, peripheral artery disease, stroke or transient ischemic attack also decreased. The proportion of younger women (60 years or less) with STEMI increased from 11.8 percent to 25.5 percent, consistent with their increased prevalence of smoking (from 37.3 percent to 73.1 percent) and obesity (from 17.6 percent to 27.1 percent). The proportion of younger patients developing STEMI despite not having hypertension, diabetes, or hypercholesterolemia increased markedly, particularly in younger women.

The authors also found that the use of reperfusion therapy increased over time, from 49.4 percent to 74.7 percent, with more frequent use of primary PCI, (11.9 percent to 60.8 percent). The use of evidence-based treatments during the first 48 hours from admission increased gradually over the 15-year period, including the early use of b-blockers, ACE inhibitors or angiotensin-receptor blockers, and statins. Also, there was increasing early use of antiplatelet agents and low-molecular-weight heparins.

Thirty-day mortality decreased from 13.7 percent in 1995 to 4.4 percent in 2010; mortality decreased from 9.8 percent to 2.6 percent in men and from 23.7 percent to 9.8 percent in women. Consistent with the decrease in mortality, major hospital complications of STEMI also decreased over this time period.

In addition, time from symptom onset to hospital admission decreased, with a shorter time from onset to first call, and broader use of mobile intensive care units.

"The progressive decline in early mortality over time observed in the present nationwide surveys is consistent with many other sources in the United States and Europe," the authors note.

"Within the STEMI population targeted by these sequential registries, the relative proportion of older patients has decreased, while the proportion of younger men and the proportion and numbers of younger women have increased. These observations suggest that future reductions in the incidence and mortality related to AMI will need specific targeting of preventive measures toward younger women and possibly younger men."

    The first heat of the Coral On TV Maidens Trophy will be hosted by Romford over 400 metres flat on Monday, 27th August. Taking their chances with the ?150 prize money are Mercury Storm, Farloe Scolari, Rockchase Jamo, Ultravox, Redhot Poker and Soviet Military.

    The three-year-old brindle dog, Mercury Storm, has been entered as the undisputed favourite with 11 to 4 chances of making a positive impact tonight. He has been racing since two seasons. His seasonal debut was in the Grade A2 400 metres flat on 9th January, 2012 at Romford. His performance was not impressive as he finished fourth after racing for 24.79 seconds.

    The race was won by the favourite entry, Winetavern Ruso, who managed the distance in 24.53 seconds.

    The first success of Ballymac Maeve?s son was in the Grade A2 400 metres flat on 8th February, 2012. The three-year-old set into an early pace, raced by the rails, over threw the challenge and led from the second position concluding the race in 24.81 seconds.

    Missing the race by just half a length was, Sporty Ted.

    Failing to retain the form led to failures in the two races that made their way next.

    The brindle dog out of, Similar Colour, landed the third success of the season on 26th May, 2012 at Romford in the Grade A1 400 metres flat race. Being the first one to speed up, making the most while staying by the rails and taking charge from the first position settled the race in 24.64 seconds.

    Losing the race just by a neck?s margin was, Southlodge Pepe.

    For the first time during the season when the brindle dog struck a back-to-back was on 11th July and on 19th July at Romford over 400 metres.

    He won the Grade A1 400 metres flat race on 19th July, 2012 at Romford in 24.45 seconds and by the margin of just half a length.

    The winning series could not be continued to a hat-trick as he ended as the runner-up in the very next race and then ended on a dreadful sixth position in the most recent race.

    It is highly likely that Mercury Storm will swing back into form tonight.

    Romney to feature personal side at convention

    (AP) ? Mitt Romney is about to get personal.

    The GOP's presidential nominee-to-be wants to use his four-day party next week in Florida to play up his life story following a summer filled with a barrage of TV ads ? courtesy of President Barack Obama and his allies ? that cast him as a ruthless and out-of-touch businessman.

    He'll surround himself with his five sons, five daughters-in-law and 15 of his 18 grandchildren. Romney's wife, Ann, will play her biggest role yet. A parade of athletes Romney met as an Olympic organizer, such as hockey legend Mike Eruzione, will be on hand. So will doting parishioners he helped as a lay pastor in the Mormon Church in Boston.

    From the stagecraft to the speakers' roster, the agenda for the convention that starts Monday is carefully crafted toward one goal: introducing Romney to the country on his own terms while projecting him as the leader the country needs in tough economic times ? and Obama as a failure on that front.

    "We go to a convention and for the first time define Mitt a little bit better," said Ron Kaufman, a top Romney adviser.

    Aides dismiss the notion that the former Massachusetts governor needs to repair a damaged image after a summer of negative ads and a recent string of missteps, including Friday when he waded into a debunked conspiracy theory by raising the issue of Obama's citizenship.

    "No one's ever asked to see my birth certificate," Romney joked at a rally in the suburbs of Detroit while visiting his native state. "They know that this is the place that we were born and raised."

    Just a day earlier, Romney caused himself another potential headache when he said big business was "doing fine" due to off-shore tax havens. It was a comment that echoed a claim similar to one he had criticized Obama for making, and it also reminded voters of Romney's own overseas accounts.

    In the coming days, Romney's team will put the finishing touches on a program that ? whether acknowledged by the campaign or not ? is intended to turn the page from a difficult summer. Among his hiccups: a foreign trip marred by self-inflicted troubles.

    The convention will be Romney's most consequential shot yet to send a precise message to Americans: that he has the experience and resolve to strengthen economy and the nation.

    But Romney's challenge is that most people have an opinion about him. Just 8 percent of people in a new Associated Press-GfK poll say they don't know how they feel about him.

    Romney's team appears undaunted.

    "We look to tell all parts of the governor's story," said Russ Schriefer, a top Romney adviser who has overseen the details of the convention. "We can show that Gov. Romney is uniquely qualified to take on the problems that this country's facing."

    The first three nights of the convention will be aimed at building the case against Obama ? specifically on his stewardship on the economy ? with speeches and videos featuring everyday Americans. Expect tough critiques from New Jersey Gov. Chris Christie on Tuesday and vice presidential candidate Paul Ryan on Wednesday.

    As Schriefer put it, the plan is to "lay down the predicate and make the case why President Obama has failed."

    Come Thursday, Romney himself will take the elaborate stage ? a Frank Lloyd Wright-styled set that Romney himself helped design ? with a speech intended to show voters that he's serious and thoughtful. He will defend his business experience, discuss his time as a church pastor, and highlight his record at the 2002 winter Olympics.

    He's spent the past year testing and sharpening the stories he will tell in front of smaller crowds, beginning in the primary campaign more than a year ago.

    Before he takes the stage, beneficiaries of the counseling Romney did as a lay pastor in the church will give testimonials about him.

    In the run-up to the convention, Romney has started telling his story in earnest.

    He wrote an op-ed piece for the Wall Street Journal this week explaining what he had learned as president and CEO of Bain Capital, a private equity firm he founded in Boston. The firm's dealings, including closed plants in key states, have provided fodder for Obama and Democrats.

    Romney used the column to highlight the company's biggest successes. "A good idea is not enough for a business to succeed," he wrote. "It requires a talented team, a good business plan and capital to execute it."

    The Romneys ? married more than 40 years ? also are featured in Sunday's issue of Parade magazine. And they sat together for an interview for Fox News Sunday during which Mrs. Romney makes pancakes. They were taping another interview Friday in the Detroit-area movie theater where they had their first date.

    While Mrs. Romney was taking on a large role in the convention, it was unclear whether her speech would be covered by broadcast television networks. They are not planning to cover Monday night when she's scheduled to take the podium.
